Wrongful death lawsuit filed after fatal crash

A wrongful death lawsuit has been filed against a man and a company in connection to a fatal accident in Clinton Township last year.

The lawsuit was filed this week in Seneca County Common Pleas Court on behalf of Elizabeth Shultz, wife of the late Robert Shultz and executor of his estate, against Enviro IT LLC, Columbus, and Arthur L. Johnson, Grove City.

Robert Shultz was driving a 1995 Chevrolet Suburban west on CR 50, and Johnson was driving a 2014 Freightliner box truck south on CR 15 July 19.

The lawsuit alleges that as Johnson approached the intersection, he failed to slow, ran a stop sign and struck the Suburban at full speed. Robert Shultz was pronounced dead at the scene.

Johnson and a passenger in the semi, Myles A. McNeal of Westerville, were taken by Tiffin Fire Rescue Division to Mercy Health – Tiffin Hospital, according to Seneca County Sheriff’s Office.

While at the hospital, Johnson allegedly declined a blood test and tried to run out of the emergency room and get into a vehicle that was waiting on him, court records state.

Mercy’s police force caught him and took him back into the emergency room, they state.

Seneca County Prosecutor Derek DeVine said Friday afternoon the situation was under investigation and review by the prosecutor’s office.

Johnson had been charged with not having a commercial driver’s license endorsement, a first-degree misdemeanor, and the charge was dismissed.

Tiffin City Prosecutor Richard Palau had requested the dismissal.

Johnson was driving a 2014 Freightliner weighing less than 26,000 pounds, and a vehicle weighing less than 26,000 pounds doesn’t require a CDL, according to Tiffin-Fostoria Municipal Court records.

The lawsuit seeks more than $25,000.

Seneca County Common Pleas Court Judge Steve Shuff is to preside over the case.
