Man pleads guilty to sex-related crime
A Deshler man pleaded guilty Monday to a sex-related crime involving a 4-year-old girl.
Julian Magallanes, 26, had been indicted by a Seneca County grand jury on charges of rape, a first-degree felony, and gross sexual imposition, a third-degree felony.
He pleaded guilty to the charge of gross sexual imposition Monday.
Seneca County Prosecutor’s Office is to seek dismissal of the rape charge when Magallanes is sentenced in September.
The prosecutor’s office and Magallanes’ attorney, Mark Klepatz, are to argue for the appropriate sentence during a hearing in Seneca County Common Pleas Court Judge Michael Kelbley’s courtroom.
The penalty for a gross sexual imposition conviction is one to five years in prison and/or a fine of up to $10,000, court records state. Magallanes would be classified as a Tier II sex offender.
The case was set to go to trial Monday, and about 35 potential jurors were awaiting proceedings as Magallanes entered his guilty plea in a nearby room.
Joyce Randell, a victim advocate, said the victim representative was consulted and was not in agreement with the case’s outcome.
