A Fostoria man has been accused of raping a 4-year-old girl.

Julian Magallanes, 26, was indicted by a Seneca County grand jury on charges of rape, a first-degree felony, and gross sexual imposition, a third-degree felony, Jan. 24. He turned himself in at Seneca County Sheriff’s Office about 6:45 p.m. Thursday, a sheriff’s office report states.

Magallanes is accused of engaging in sexual conduct and having sexual contact with a 4-year-old girl, according to court records and Seneca County Prosecutor’s Office.

The penalty for a rape conviction is a mandatory sentence of 15 years to life in prison and/or a fine of up to $20,000, court records state. If convicted of rape, Magallanes would be classified as a Tier III sex offender.

The penalty for a gross sexual imposition conviction is one to five years in prison and/or a fine of up to $10,000, court records state. If convicted of gross sexual imposition, Magallanes would be classified as a Tier II sex offender.

Magallanes was incarcerated at Seneca County Jail Friday. His case is to be heard by Seneca County Common Pleas Court Judge Michael Kelbley.

Magallanes’ bond hearing was continued until an attorney could be secured, a court spokeswoman said.
